Das Buch stellt dazu die publizistische Freiheit und Vielfalt mit ihren Auswirkungen auf die Grundung und das Innenrecht von Medien sowie auf mogliche Anspruche Dritter dar. Es schliessen sich zwei Kapitel uber die Finanzierung und den okonomischen Wettbewerb zwischen Medien an. Der nachste Teil hat die Information der Offentlichkeit zum Inhalt. Darin werden Informationsformen und Informationsverhaltensweisen vorgestellt, danach wird auf die offentlichen Informationsinteressen eingegangen. Anschliessend thematisiert der Autor die Beschaffung und Uberprufung von Informationen durch die Medien und die Grenzen der Recherche. Es folgt das eigentliche 'Kerngeschaft' der Medien. Dazu geht das Buch auf die Freiheit und Unfreiheit von Informationen sowie auf die Bild- und die Wortberichterstattung ein. Es schliesst sich ein Teil uber unrichtige und inhaltlich unzulassige Informationen an, in dem insbesondere auf Auslegungsfragen, die Behandlung von Tatsachen- und Meinungsausserungen und den Jugendschutz eingegangen wird. Den Schluss bildet das 'Aufsichtsrecht', d.h. Abschnitte uber die Macht und die Kontrolle der Medien, die Gegendarstellung und die zivilrechtlichen Anspruche.

Der Urheber ist meist nicht in der Lage, sein Produkt selbst in der Öffentlichkeit zu vermarkten, daher schließt er mit dem Verwerter seines Werkes einen Vertrag ab. Mit diesem erhält sein Vertragspartner die Erlaubnis, das Werk auf dem Markt zu vertreiben. Aus dem erzielten Erlös steht dem Werkurheber ein angemessenes Entgelt zu. In der Zeit der „Neuen Medien“ stellt die Einräumung von Nutzungsrechten an unbekannten Auswertungstechniken für viele Werknutzer eine Hürde bei der Auswertung ihrer Werke dar. Hier entsteht die Problematik der „neuen Nutzungsart“ als zentraler Streitpunkt zwischen Urhebern und Lizenznehmern bzw. Werknutzern. In der Rechtsordnung stehen sich einerseits der „Schutz des geistigen Eigentums“ , also die Interessen der Urheber, und andererseits die Interessen der Lizenzpartner, dem Schutz vor ausreichender Einräumung der Nutzungsrechte zur Verwertung der Werke, gegenüber. Doch wann liegt eine neue Nutzungsart vor und welche Kriterien machen sie aus? Die vorliegende Arbeit soll genau dieser Fragestellung nachgehen. Da es in den letzten Jahren einen starken technischen Fortschritt im Bereich der elektronischen Medien zu verzeichnen gab, sind auch immer mehr neue Nutzungsarten i. S. d. § 31 (4) UrhG entstanden. Zentral soll die Frage, ob Fernsehserien auf DVD i. S. d. § 31a UrhG als neue Nutzungsart gelten, beleuchtet werden. Zunächst werden hierzu die gesetzlichen Grundlagen geschaffen, indem § 31 (4) UrhG definiert und die Um- bzw. Neugestaltung des Gesetzes, zugunsten des Werknutzers, in § 31a UrhG näher betrachtet wird. Danach gibt die Arbeit einen Einblick wann und unter welchen Voraussetzungen eine neue Nutzungsart i. S. d. § 31a UrhG vorliegt. Hierbei wird die DVD als digitales Trägermedium für Filmwerke als neue Nutzungsart näher beleuchtet, das Urteil des Falls „Der Zauberberg“ wird dabei der Veranschaulichung dienen. Anschließend werden TV-Serien auf DVD als neue Nutzungsart, in Verbindung mit den zuvor gewonnenen Kenntnissen, in den Mittelpunkt der Diskussion gestellt.
